What is a works suspension notice?
A works suspension notice is a formal written notice served by a main contractor directing a subcontractor to suspend their works on a project. It is a significant contractual step, typically used as a last resort before termination or when an immediate safety issue requires the subcontractor to stand down.
Most standard form subcontracts contain provisions governing suspension, including the required grounds, notice period and the parties' rights and obligations during a suspension. Suspending works without following the contractual procedure can expose the main contractor to a claim for wrongful suspension.
Common grounds for suspension include persistent failure to meet programme requirements, repeated quality failures, refusal to comply with site rules or H&S requirements, and non-performance following prior written warnings. In some cases, suspension may follow from a payment dispute where the subcontractor has exercised their own right to suspend under the Construction Act.
A suspension notice is often a precursor to termination. It gives the subcontractor a final opportunity to remedy the default and provides the main contractor with a further step in the evidence chain if termination becomes necessary.

Telling a subcontractor on site that their works are suspended is not a contractual suspension. Without a written notice served in accordance with the subcontract, the suspension has no legal effect and does not trigger the clock on any contractual remedy period.

If a suspension escalates to termination or adjudication, you will need to show the grounds for suspension and that proper notice was given. Without a written notice at the time, reconstructing the grounds from emails and memory is unreliable.
