What is an early warning notice?
An early warning notice is a formal notification issued when a party becomes aware of any matter that could increase the total cost, delay completion, or impair the performance of the works. It is one of the most important risk management tools in a construction contract.
Under NEC4 (and NEC3) contracts, both the contractor and project manager are required to give early warning notices as soon as they become aware of any such matter. Failure to give an early warning when one was due can affect the contractor's entitlement to a compensation event.
JCT contracts do not use the term early warning but include similar notice requirements for delays and potential cost impacts. In practice, proactive written notices are good commercial management regardless of the contract form.
The purpose of an early warning is not to apportion blame but to get both parties to engage with a risk before it becomes a problem. A well-managed early warning register is one of the hallmarks of a professionally run project.

The Limits of Manual Processes

This template works well for one-off notices. Across a full project with multiple risk events, manual management breaks down quickly.
Informal emails do not satisfy contract requirements
Under NEC contracts, an early warning must be issued in writing in the prescribed form. A general email flagging a concern is unlikely to constitute a valid early warning, which can affect entitlement to compensation events.
No tracking of who was notified and when
When programme disputes arise, the question is always: who knew about the risk and when? Without a log of every early warning issued, demonstrating awareness of a risk becomes difficult to prove.
No link to the risk register or compensation events
